a tree protection order may be placed on a tree by the local planning authority (LPA) where it looks likely that the tree may be at risk of being removed. The land owner then has to apply to the lpa if they wish to changed the tpo, to undertake works to or if they wish to remove the tpo protected tree. Once permission is received, tree work can go ahead. If the land owner works on, or even fells, the tree without permission, a fine can be the punitive measure and there is also a responsibility for the land owner to replant a similar tree in the same location or in an agreed location.
